These Terms of Service ("Terms") are a binding agreement governing your use of WebPilot, including the WebPilot website, customer portal, PathPilot integration, telemetry, remote-desktop relay, file-transfer features, software updates, and related hosted services (collectively, the "Service"). "WebPilot" in these Terms means WebPilot, TormachTips, and the individual or entity operating the Service, as applicable. By creating an account, checking the acceptance box, installing WebPilot software, accessing a controller through the Service, or otherwise using the Service, you agree to these Terms.
WebPilot is intended primarily for remote monitoring and convenience. It is not a machine-safety system, emergency-control system, deterministic industrial-control network, or substitute for a qualified operator physically present at the machine. Remote desktop access can transmit commands that cause real machine motion, spindle operation, crashes, tool or workpiece damage, fire, property damage, serious bodily injury, or death.
You knowingly and voluntarily assume the risks of using remote access with CNC machinery, including risks arising from latency, stale or inaccurate displays, delayed or lost input, unexpected motion, loss of Internet or power, browser/server/controller/VNC failure, software defects, unauthorized access, service interruption, and inability to regain remote control at the moment it is needed.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, YOU RELEASE WEBPILOT FROM CLAIMS ARISING FROM THESE ASSUMED RISKS OR FROM WEBPILOT'S ORDINARY NEGLIGENCE IN PROVIDING THE SERVICE, including claims for personal injury, death, equipment or property damage, lost work, lost production, downtime, or data loss. This release does not apply to willful or wanton misconduct, fraud, or any liability that applicable law does not permit to be released or limited.
WebPilot provides browser-based access to supported PathPilot-equipped Tormach CNC controllers. The Service may provide machine telemetry, account services, software updates, file transfer, and a hosted relay for remote PathPilot desktop access. WebPilot normally uses an outbound encrypted connection from the controller so users do not need to expose an inbound VNC port at the shop.
You must be at least 18 years old and legally capable of entering into a binding agreement. If you use WebPilot for a company, shop, employer, or other organization, you represent that you are authorized to accept these Terms on that organization's behalf and to access the controllers you connect to the Service.
You must provide accurate account information and keep your account password, VNC password, email account, machine tokens, and other credentials secure. Do not share credentials with anyone who should not be able to access your machine. You are responsible for activity performed through your account or credentials, except to the extent applicable law provides otherwise. Notify WebPilot promptly if you believe credentials or a controller installation have been compromised.
New eligible controllers may receive a 48-hour free trial. The trial begins when the controller successfully connects and binds to WebPilot for the first time, not when the account is created. Trial eligibility may be associated with the physical controller to prevent repeated trials.
Current advertised pricing is $10/month or $100/year for the first machine and $5/month or $50/year for a second machine on the same account. Additional machines, special arrangements, and future pricing may be handled separately. Unless otherwise agreed, subscription access covers the hosted WebPilot service and does not transfer ownership of server infrastructure or grant a perpetual hosted-service entitlement.
WebPilot may change pricing or subscription terms prospectively. Material changes affecting an existing paid period will be communicated before they take effect for a future renewal or billing period.
You may request cancellation or non-renewal through the contact form. When a trial or paid entitlement ends, customer telemetry and remote-desktop access may be disabled while the installed controller software remains connected for account status, updates, support, or later reactivation.
Unless a separate written agreement says otherwise, payments are for the selected service period and are generally non-refundable once that period begins, except where required by law or where WebPilot agrees to a refund because of a billing error or material service problem. Cancellation stops future renewal or future service periods; it does not automatically create a prorated refund for time already purchased.
WebPilot depends on Internet connectivity, your network and controller, power, hosting infrastructure, browsers, PathPilot, VNC, operating systems, certificate infrastructure, and other third-party software and services. Any of them can fail, degrade, restart, disconnect, become congested, or provide stale information without warning, including during active machine operation and at the worst possible time.
The Service is not designed or warranted to provide deterministic timing, continuous command delivery, guaranteed screen freshness, guaranteed reconnection, or uninterrupted control. Unless a separate written service-level agreement exists, no uptime, latency, response-time, recovery-time, or availability commitment applies. Maintenance, updates, emergency security work, abuse prevention, and events beyond WebPilot's reasonable control may interrupt the Service.
You may not use WebPilot to break the law, access a controller or account without authorization, interfere with the Service, probe or bypass security controls, distribute malware, overload infrastructure, resell access without permission, defeat trial or billing controls, or use the Service in a way that creates an unreasonable security, safety, or operational risk. Reasonable security testing of your own installation should be coordinated in advance when it could affect shared infrastructure.
WebPilot software is licensed for use with the Service and supported controllers; it is not sold as a transfer of all intellectual-property rights. WebPilot may provide software updates for security, compatibility, reliability, or features. Updates can alter behavior, require a PathPilot restart or user approval, temporarily interrupt service, or become necessary for continued compatibility.
Use of the Service involves processing account information, machine identifiers, connection information, telemetry, remote-desktop traffic, uploaded files, and diagnostic information as described in the Privacy Policy. By using WebPilot, you acknowledge that this processing is necessary to provide, secure, support, and troubleshoot the Service.
WebPilot is an independent service and is not represented as an official Tormach product. Tormach, PathPilot, product names, and related marks belong to their respective owners. WebPilot does not control third-party products, networks, hosting providers, browsers, operating systems, or software, and compatibility or behavior can change when those products or services change.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE AND ALL RELATED SOFTWARE, CONTENT, TELEMETRY, REMOTE ACCESS, FILE TRANSFER, AND SUPPORT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITH ALL FAULTS. WEBPILOT DISCLAIMS ALL WARRANTIES, EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, SAFETY, SECURITY, AVAILABILITY, AND RESULTS, TO THE EXTENT SUCH WARRANTIES MAY LAWFULLY BE DISCLAIMED.
WebPilot does not warrant that the Service will be uninterrupted, timely, secure, error-free, free from harmful components, compatible with every controller or network, or capable of detecting or preventing machine, network, software, configuration, security, or operator errors. Nothing in these Terms excludes a warranty or statutory right that cannot legally be excluded.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WEBPILOT WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES; PERSONAL OR BUSINESS INTERRUPTION; LOSS OF USE, PRODUCTION, PROFITS, REVENUE, BUSINESS, GOODWILL, PROGRAMS, FILES, OR DATA; OR DAMAGE ARISING FROM MACHINE OPERATION, REMOTE COMMANDS, UNAUTHORIZED CREDENTIAL USE, LATENCY, STALE INFORMATION, NETWORK OR SERVICE FAILURE, OR RELIANCE ON WEBPILOT AS A SAFETY OR EMERGENCY-CONTROL SYSTEM.
For any claim that may lawfully be limited but is not otherwise released under these Terms, WebPilot's total aggregate liability arising out of or relating to the Service will not exceed the greater of (a) the amount you paid WebPilot for the Service during the 12 months immediately preceding the event giving rise to the claim or (b) $100. This limitation applies regardless of legal theory and even if a remedy fails of its essential purpose or WebPilot was advised that damages were possible. These limitations do not apply to liability that applicable law does not permit to be excluded or limited.
To the extent permitted by law, you agree to defend, indemnify, and hold harmless WebPilot and its owner/operator, employees, contractors, and service providers from third-party claims, losses, liabilities, damages, judgments, costs, and reasonable attorney fees arising from or relating to your operation of machinery; your programs, tooling, workholding, work area, or safety practices; your use or misuse of remote access or file transfer; your sharing or compromise of credentials; your violation of law; or your material breach of these Terms. This section does not require you to indemnify WebPilot for claims to the extent caused by conduct that cannot lawfully be indemnified or released.
WebPilot may suspend, restrict, or terminate access for nonpayment, abuse, security concerns, suspected compromise, unlawful use, material violation of these Terms, emergency maintenance, or conduct that threatens customers, machines, data, or shared infrastructure. Where practical, WebPilot will attempt to provide notice and an opportunity to correct ordinary account or payment issues, but immediate action may be taken when reasonably necessary for safety, security, or service integrity.
These Terms and any dispute arising out of or relating to the Service are governed by the laws of the State of Ohio, without regard to conflict-of-law principles, except to the extent federal law or another non-waivable law applies. Subject to any non-waivable venue right, you consent to personal jurisdiction in Ohio and agree that disputes will be brought in a court of competent jurisdiction located in Ohio.
Before filing a lawsuit, each party agrees to make a good-faith effort to resolve the dispute informally for at least 30 days after written notice describing the dispute and requested resolution, unless emergency injunctive relief is reasonably necessary or applicable law does not permit such a requirement. Notices to WebPilot may be sent through the contact form.
You agree to conduct this transaction electronically. Checking the Terms acceptance box and submitting account registration constitutes your electronic assent to these Terms. You may print or save this page for your records. Electronic records and signatures are intended to have the same effect as permitted under applicable electronic-transactions law.
These Terms may be updated as the Service changes. The current version will be posted at this URL with an effective date. Material changes will be communicated when practical. Changes apply prospectively to the extent required by law. Continued use after an updated version takes effect constitutes acceptance only to the extent permitted by applicable law; WebPilot may require affirmative re-acceptance of material changes.
These Terms, together with the Privacy Policy and any written service-specific terms expressly incorporated into them, constitute the agreement governing the Service. If a provision is held unenforceable, it will be enforced to the maximum extent permitted and the remaining provisions will remain in effect. Failure to enforce a provision is not a waiver. You may not assign your account or these Terms in a manner that transfers unauthorized machine access; WebPilot may assign operation of the Service in connection with a business reorganization, transfer, or successor. Headings are for convenience only.
Questions about these Terms, cancellation, billing, safety provisions, or the Service can be sent through the contact form.
